Agreement to Terms

These Terms and Conditions ("Terms") govern your use of the Gace Builds website located at gacebuilds.com ("Website") and any related services provided by Gace Builds ("we," "us," or "our").

By accessing or using our Website, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Website or use our services.

Services

Gace Builds provides web development, design, SEO, and related digital services for small businesses. Our services include but are not limited to:

  • Website design and development
  • Landing page creation
  • Search engine optimization (SEO)
  • Content writing
  • Website maintenance
  • Training and support

Service Agreement

For all paid services, a separate Service Agreement or proposal will be provided that outlines:

  • Scope of work
  • Deliverables
  • Timeline
  • Pricing and payment terms
  • Revision policies

The Service Agreement, when signed or accepted, becomes part of these Terms and Conditions.

Payment Terms

Deposits

Unless otherwise stated in the Service Agreement:

  • A 50% deposit is required to begin work on any project
  • The remaining 50% is due upon project completion and before final files are delivered

Payment Methods

We accept payment via:

  • Bank transfer (BDO, BPI, UnionBank)
  • GCash
  • Maya (PayMaya)
  • PayPal

Late Payments

Late payments may result in:

  • Project delays or suspension
  • Website being taken offline until payment is received
  • Additional fees as specified in the Service Agreement

Client Responsibilities

To ensure successful project completion, clients agree to:

  • Provide all necessary content, images, and materials in a timely manner
  • Respond to requests for feedback or approval within 5 business days
  • Provide accurate business information
  • Ensure they have rights to use all content provided to us
  • Review and test deliverables during the revision period

Intellectual Property

Client Materials

You retain ownership of all content, images, logos, and materials you provide to us. By providing these materials, you grant us a license to use them solely for the purpose of completing your project.

Delivered Work

Upon full payment, you will own the custom website design and content created specifically for your project. We retain ownership of:

  • Any pre-existing code, templates, or frameworks used
  • General design concepts and techniques
  • Tools and processes developed by Gace Builds

Portfolio Rights

We reserve the right to display completed projects in our portfolio and marketing materials unless you specifically request otherwise in writing.

Revisions and Changes

The number of revisions included in your project will be specified in the Service Agreement. Generally:

  • Minor text changes and adjustments are included
  • Major design changes may incur additional fees
  • Changes requested after project completion will be quoted separately

Project Timeline

Project timelines are estimates and depend on:

  • Timely client feedback and content delivery
  • Scope of the project
  • Current workload

Delays caused by client non-responsiveness may result in timeline extensions and, in some cases, additional fees.

Warranties and Disclaimers

We warrant that:

  • Work will be performed in a professional manner
  • Deliverables will function as specified in the Service Agreement
  • We will address any bugs or errors within 30 days of launch at no additional cost

We do not warrant:

  • Specific business results, traffic, or revenue from your website
  • Search engine rankings (SEO results are not guaranteed)
  • Third-party services, plugins, or platforms

Limitation of Liability

To the maximum extent permitted by law, Gace Builds shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits or revenue
  • Loss of data
  • Business interruption

Our total liability shall not exceed the amount paid by you for the specific service in question.

Termination

Either party may terminate a project with written notice. In case of termination:

  • Client is responsible for payment of all work completed to date
  • Deposits are non-refundable unless otherwise agreed
  • All client materials will be returned
  • Incomplete work may be delivered at our discretion

Website Use

By using our Website, you agree not to:

  • Use the Website for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Website
  • Interfere with the proper functioning of the Website
  • Copy or reproduce content without permission

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines. Any disputes arising from these Terms or your use of our services shall be resolved in the courts of Metro Manila, Philippines.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Website after any changes constitutes acceptance of the new Terms.
